California Resignation and Acceptance by Trustee
A California Resignation and Acceptance by Trustee allows a current trustee to step down and a successor trustee to formally take over administration of a trust. California law permits a trustee who has accepted a trust to resign only in limited ways, including as the trust instrument provides, with the consent of the person holding the power to revoke a revocable trust, with the consent of the adult beneficiaries of an irrevocable trust, or by court order. The package generally includes the written resignation, any required consent, the successor trustee's written acceptance, notice to beneficiaries, a receipt for delivery of trust property, and an updated Certification of Trust for banks, brokerages, and title companies. A resigning trustee ordinarily remains responsible for trust property until it is actually delivered to the successor, and a change of trustee can trigger notice deadlines, so the trust document and the applicable requirements should be carefully reviewed before the forms are used.
